3.1 To use the platform, users must create an account, complete the KYC (Know Your Customer) process, and provide accurate and up-to-date information.
3.2 The company reserves the right to approve or reject any registration or KYC verification at its sole discretion.
4.1 Investors can fund their eWallets on the portal using approved payment methods.
4.2 Once funds are available in the eWallet, investors can select and purchase shares in specific real estate projects.
4.3 Upon successful purchase, investors will receive a downloadable investment contract summarizing the terms of the investment.
5.1 Returns are calculated and distributed based on the terms specified for each investment project.
5.2 Profits or matured amounts will be credited to the investor’s eWallet after the stipulated period.
5.3 Investors may withdraw funds from their eWallets to a linked bank account or mobile wallet, subject to any applicable fees.
6.1 Investors may earn a 3% commission for referring new users who successfully complete an investment.
6.2 Blessmarked Real Estates Limited reserves the right to modify or terminate the referral program without prior notice.
7.1 All investments are subject to market risks, including fluctuations in property values and changes in economic conditions.
7.2 Blessmarked Real Estates Limited does not guarantee specific returns or the preservation of invested capital.
8.1 The company may impose fees for transactions, withdrawals, or account maintenance. These fees will be communicated on the portal.
8.2 Investors are responsible for any third-party fees incurred during transactions, such as bank or mobile wallet charges.
9.1 Blessmarked Real Estates Limited is committed to protecting user privacy in accordance with its Privacy Policy.
9.2 Users agree not to share confidential information about their investments, account details, or platform operations with unauthorized parties.
10.1 Users must not:
a. Use the platform for illegal activities.
b. Create multiple accounts without authorization.
c. Interfere with the operation of the portal through hacking or other malicious activities.
11.1 Blessmarked Real Estates Limited reserves the right to suspend or terminate accounts that violate these Terms and Conditions.
11.2 Users may terminate their accounts by submitting a written request to customer support.
12.1 Blessmarked Real Estates Limited is not liable for losses arising from:
a. Delays or interruptions in portal operations.
b. Investment risks, including market fluctuations or project underperformance.
12.2 The company’s total liability is limited to the amount invested by the user in a specific project.
13.1 Any disputes will be resolved through binding arbitration in accordance with the laws of Republic of Kenya.
13.2 The arbitration venue will be in the Republic of Kenya, and the decision will be final and binding.
14.1 Blessmarked Real Estates Limited may update these Terms and Conditions at any time. Changes will be communicated through the portal.
14.2 Continued use of the platform after updates constitutes acceptance of the revised terms.
15.1 These Terms and Conditions are governed by the laws of Republic of Kenya.
15.2 Any legal proceedings must be initiated in courts located within Republic of Kenya.
